2009 Digital Forensics and E-Discovery Seminar

On Tuesday, October 6, 2009, the VPO, in conjunction with the Vermont Bar Association, held its 2009 Digital Forensics and E-Discovery seminar at the Chittenden Bank/People's United in downtown Burlington.  It was a well attended event and included attorneys, paralegal students, and IT specialists, in addition to VPO members.  Speaker Gary Kessler, a Certified Computer Examiner, showed examples of how information is captured digitally from cell phones, Blackberries, and PC's in criminal investigations.  Mr. Kessler also discussed Daubert and Frye standards with admitting forensically obtained evidence in court. In the afternoon, Rob Fitzgerald of The Lorenzi Group discussed hold letters with clients in civil discovery and how electronic information is stored and obtained on the server level with large corporate clients.  The day ended with a presentation from Attorney Liz Miller explaining the recent changes in the Federal and Vermont Rules of Civil Procedure with respect to production of Electronically Stored Information (ESI).
